What is the Master Architectural Control Committee?
The “Covenants, Conditions and Restrictions” (commonly referred to as “deed restrictions” or “CCRs”) that have been adopted for all of the Sub-Associations in Barton Creek North include requirements that Owners of Lots in Barton Creek secure the approval of a ‘design review board’ or ‘architectural control committee’ prior to pursuing any “Improvements” to their properties. These deed restrictions are legal requirements that “run with the land” and are binding on all Owners in Barton Creek North. “Improvements” is broadly defined in the deed restrictions to include any new construction, whether a new home or addition or remodeling, as well as many other proposed activities, like constructing a new pool, an outdoor kitchen, a sports court, or installing a new roof, new outdoor lighting, or new landscaping or fencing. Even repainting the exterior of your home is an “Improvement” which the MACC is authorized to approve. Nine of the 12 Sub-Associations in Barton Creek North have chosen to have the Master Architectural Control Committee (the”MACC”) administer this program. Pursuant to authorization in the deed restrictions, the MACC has adopted Architectural Guidelines and other documents to assist it in ensuring that a Sub-Association’s deed restrictions are honored with respect to construction activities, and to assist Owners in pursuing their construction projects. Who is the MACC and how does it operate?
The MACC is a 5-member committee of volunteers who live in Barton Creek North. MACC members are appointed by the Barton Creek North POA Board and are supported by FirstService Residential, a community management company retained by Barton Creek North POA. The MACC meets routinely to address ongoing and proposed construction projects in Barton Creek North. The MACC has adopted Architectural Guidelines and other project-related documents to assist Owners in securing the MACC’s approval of their proposed construction projects, and they can all be found on the Barton Creek North POA website (at bartoncreeknorth.com) under the MACC Documents tab.
How do I seek and secure the MACC’s approval of my project?
The MACC meets routinely, and it encourages Owners to reach out to FirstService Residential to schedule a meeting to discuss their proposals. The Architectural Guidelines, which can be found under the MACC Documents tab on the Barton Creek North POA website (at bartoncreeknorth.com), include information regarding the MACC’s approval process, the fees, deposits and document execution required by the MACC, and the forms needed to pursue the MACC’s action on projects. Are there conditions that the MACC imposes on Owners and contractors when a construction project is subject to the MACC’s oversight?
Yes. The MACC has adopted several construction-related conditions that Owners and their contractors/builders are required to comply with, including day of week and time-of-day work hour limits, site maintenance and clean-up requirements, noise limitations, parking limitations, and many others. All of these conditions can be found, along with the Architectural Guidelines, in the MACC Documents tab on the Barton Creek North POA website (at bartoncreeknorth.com).
I want to trim and possibly remove trees in my yard. Do I need the MACC’s approval?
Generally, no, but the Architectural Guidelines do prescribe limitations in Sec. 3.11 regarding tree trimming and removal. Outside of an emergency where tree trimming or removal may be necessary for the health and safety of persons or property, Owners should review the Architectural Guidelines for the MACC’s tree trimming and removal requirements and certainly reach out to FirstService Residential with questions before removing any trees.
I want to remodel my kitchen and paint the exterior of my home. Do I need MACC approval for these projects?
Construction activities that are internal to a home are not required to be approved by the MACC. However, pursuant to the deed restrictions and the Architectural Guidelines, the MACC does oversee the siting and screening of ancillary construction-related facilities, like dumpsters, storage pods and port-o-potties, that may be associated with an internal home construction project. So, if there is an external “footprint” to an internal construction project, like a dumpster or storage pod, for example, the MACC’s approval of the siting and screening of such external facilities is required, but nothing more—no fees or applications to complete.
Pursuant to the deed restrictions and the Architectural Guidelines, the MACC has approval authority over external painting projects, but such approval is usually quickly authorized if Owners afford adequate samples of their paint choices, but nothing more is required—no fees or applications to complete. If I want to paint the interior of my home but do not require a dumpster or port-o-potty, do I need MACC approval?
No, there is no MACC approval required for an internal paint project if there are no external ancillary construction-related facilities associated with the project.
What should I do if I think a construction project in my neighborhood is in violation of the Architectural Guidelines?
The Architectural Guidelines require Owners, and their contractors and builders, to adhere to several requirements before, during and even following construction. If you think a requirement of the Architectural Guidelines is not being adhered to, please reach out to the MACC’s community management company, FirstService Residential, at ACC.CTX@fsresidential.com or (512) 266-6771. The MACC will investigate and take any action necessary to ensure that the requirements of the Architectural Guidelines are being met or will be met.
